Public hearing request by the Chatham County Board of
Commissioners to consider amendments to the following
Ordinance as generally follows. See the draft ordinance for a
complete description of amendments:
Chatham County Watershed Protection Ordinance
(amendments in compliance with the Jordan Lake Nutrient
Management Strategy Buffer Rules) aimed to restore, protect
and maintain the water quality of Jordan Lake. The State of
North Carolina adopted rules 15A NCAC 02B.0262-.0273 for this
purpose. Session Laws 2009-216 and 2009-484 modified the rules.
Section 101, Authority and Enactment, to include the statutory
references requiring the Jordan Buffer rules.
Section 109, Definitions, to include new and amended definitions
to accommodate the Jordan Buffer Rules.
Section 301 (I): Addition of Jordan Lake Watershed area as
identified on the revised Chatham County Watershed Protection
Map. This new watershed area includes or incorporates existing
watersheds such as River Corridor and WS-IV-CA, Critical Areas.
Section 304 (J): Jordan Lake Watershed Riparian Buffer
Requirements. The Table of Uses indicates allowed and
prohibited buffer activity and uses that are exempt, allowable
and allowable with mitigation within the Jordan Lake
Watershed.
Section 305: Mitigation. Where mitigation is required from the
Table of Uses, this section describes the methods allowed for
mitigating buffer losses over certain thresholds of disturbance.
Section 508, Appeals from the Watershed Review Board, to
incorporate changes to appeals to accommodate the Jordan Buffer
Rules.
Amend the Watershed Protection Map of Chatham County, North
Carolina to include the Jordan Lake Watershed overlay district
as defined in Section 301(I). |

Proposal by the Chatham County Environmental Review Board
to amend Section 304 and other portions of the Chatham
County Watershed Protection Ordinance concerning Riparian
Buffers Areas. The proposal increases some existing buffer
areas, requires buffers on additional drainage ways, specifies
permitted and prohibited uses within the buffer areas, and
specifies procedures for review of uses. The proposal also
provides a section addressing purpose and intent as well as
adding definitions and revising definitions in the Ordinance. |

input on proposed text amendments to the Chatham County
Watershed Protection Ordinance. The amendments include the
following: amend Section 304, Buffer Areas Required, to
increase stream buffer widths along perennial streams,
intermittent streams, and unclassified streams countywide and to
prohibit additional uses within those buffers; amend Section
501 (C) & (F), Watershed Administrator and Duties Thereof
and Section 503 (C), Changes and Amendments to the
